Shipping and Delivery
FOB Terms – Title and Risk of Loss
Gartner Refrigeration, Inc. operates under FOB Destination terms. Title and risk of loss for all products transfer from Gartner Refrigeration, Inc. to the customer upon delivery at the customer's designated facility ("Destination"). Gartner Refrigeration Inc. retains responsibility for the goods during transit until they are delivered to the customer.
Transportation Costs
All transportation, shipping, and handling charges are the responsibility of the customer and will be added to the invoice or billed separately unless otherwise agreed in writing. If the customer does not specify a carrier or shipping method, Gartner Refrigeration Inc. reserves the right to select the method of transportation and routing.
Collect Shipping Accounts
When the customer requests that the shipment be made using their collect shipping account, the following special terms apply:
- FOB Origin: Title and risk of loss for products transfer from Gartner Refrigeration, Inc. to the customer upon release to the carrier at Gartner Refrigeration, Inc.'s shipping point ("Origin").
- Freight Insurance: Since the customer assumes responsibility at Origin, they are solely responsible for securing adequate freight insurance. Gartner Refrigeration Inc. bears no responsibility for any loss or damage occurring in transit.
- Freight Claims: The customer is responsible for filing any necessary freight claims directly with the carrier. Gartner Refrigeration Inc. will provide reasonable assistance upon request, but assumes no liability for claim resolution under collect shipping terms.
Delivery Schedules
Any delivery dates provided by Gartner Refrigeration, Inc. are estimates only and depend on timely receipt of all necessary information from the customer. Gartner Refrigeration, Inc. will not be liable for delivery delays caused by factors outside of its reasonable control.
Partial Shipments
Gartner Refrigeration, Inc. reserves the right to make partial shipments unless otherwise specified in writing by the customer. Each partial shipment will be treated as a separate transaction, and payment will be due accordingly.
Inspection and Acceptance
The customer must inspect all products upon delivery. Products will be deemed accepted unless Gartner Refrigeration, Inc. receives written notice of rejection within five (5) business days. Rejection is limited to material deviations from agreed specifications.
Packages Lost in Transit or Damaged by the Carrier
Lost shipments must be reported to Gartner Refrigeration, Inc. within 60 calendar days of the original shipping date. Customers should refuse visibly damaged shipments at delivery or clearly note "Damage" on the delivery receipt. Visible damage or shortage must be reported to the shipper within 30 calendar days of delivery. Concealed damage or shortage must be reported within 5 calendar days of delivery. Supporting documentation, including photos, must be submitted to initiate the claims process.
Package Marked as Delivered (Proof of Delivery Provided)
- No Replacement or Credit: If the customer claims non-receipt of a package but the carrier provides a Proof of Delivery (POD) confirming it was delivered to the correct shipping address, Gartner Refrigeration Inc. is not responsible for issuing a replacement or credit.
- Customer Assumes Risk Post-POD: Once delivery is confirmed via POD, the responsibility for the shipment transfers to the customer. Any issues (e.g., internal misplacement, theft, etc.) must be resolved by the customer.
Return Policy
Restocking Fees
A 30% restocking fee applies to all returns unless a different fee is required by the manufacturer. This fee is non-negotiable.
Return Shipping Costs
Unless otherwise specified, the customer is responsible for all shipping return costs.
